DECISION, REASON & PENALTY
----
An information lodged by Stipendiary Steward Mr J Muirhead against Mr J Noakes, Junior Driver, driver of WHODATDARE, alleging a breach of Rule 869 (3) (b) and Easing Down Regulation in that he drove his horse carelessly causing it to break when contesting a position with SUPREME ROCKET driven by Mr M White with approximately 1900 m to run. Mr Noakes admitted the breach and was present at the hearing assisted by Senior Horseman Mr T Macfarlane.
--Mr Muirhead demonstrated the incident by use of the video film. Going into the bend at the end of the home straight in the first lap of the race, SUPREME ROCKET had at least a head advantage over WHODATDARE and Mr White attempted to ease down WHODATDARE, there being no horse racing on the inside of WHODATDARE at that time. Mr Noakes did not concede his position as required by the Easing Down Regulation. WHODATDARE then broke from its gait. Mr Noakes and Mr Macfarlane accepted Mr Muirhead's version of the incident.
--PENALTY
--Mr Muirhead said the offending was not a serious breach, and that Mr Noakes had indicated he preferred a suspension rather than a fine. He said Mr Noakes had no breaches of the Rules recorded against him. He suggested a two day suspension. Mr Noakes and Mr Macfarlane accepted the submissions of Mr Muirhead. In fixing penalty I took into account the following matters :

- Mr Noakes' clear driving record. --
- The offending was at the lower end of the scale. --
- The submissions of Mr Muirhead. --
- The acceptance of those submissions by Mr Noakes and Mr Macfarlane.
I suspended Mr Noakes' horseman's licence until the end of racing on the 1st March 2007, which is effectively a two day suspension.
