As the result of an incident in Race 7 at the Canterbury Jockey Club’s meeting on Saturday 3 October 2009, Ms K Williams (Licensed Jockey) was charged with a breach of Rule 871(1)(d) - the careless riding rule.

Ms Williams admitted the charge which is, therefore, deemed to be proved.

It was alleged that Ms Williams (“Eel Win”) shifted in near the 1000 metres when not clear, causing a severe check to “Flight Point” (S Muniandy) and also hampering “Titsgittin”) (L Robinson).

Video evidence of the incident was shown to us by Assistant Stipendiary Steward, J McLaughlin from two different camera angles namely the head on camera and the side on camera.

The video evidence demonstrated how Ms Williams was racing in a four wide position going forward, with three other horses on her inside namely “Flight Point” and “Titsgittin”) and one other.

--

Ms Williams commenced an inward movement coming into contact with “Flight Point” and as a consequence, “Titsgittin” was hampered.  It appeared, from the evidence shown to us that L Robinson, in the process, was protecting the horse inside him from being interfered with, which was being caused by Ms Williams’ inward movement.

The side on camera angle showed quite clearly that Ms Williams was not her own length and another length clear at the appropriate time.  In response, Ms Williams believed that Mr Robinson moved outwards and therefore contributed to the incident.  She said that he had space, and was travelling keenly.

In response to that, Stipendiary Steward Davidson said that Ms Williams was racing on a four wide line and as a consequence of Ms Williams’ inward movement that Mr Robinson was trying to protect the horses on his inside, and also to keep off the heels of “Monkey Magic” ridden by J Collett.  He conceded that Mr Robinson may possibly have moved outwards slightly.

PENALTY SUBMISSIONS

Mr Davidson advised the hearing that Ms Williams has had only one charge against her in the past twelve months.  She was suspended pursuant to the careless riding rule in February 2009, for four days.  He said that she is a busy rider, and that her record is reasonable.

However, he did consider that Ms Williams’ carelessness was in the mid to high range and called for a suspension of a period of four to six days.

Ms Williams had no submissions with regard to penalty.

PENALTY DECISION

--

Our starting point for penalty in this instance is a six day suspension.  We agree that Ms Williams’ carelessness was in the mid to high range.  However, in reaching our decision on penalty, we take notice of Ms Williams’ good riding record, her immediate guilty plea and the concession by Mr Davidson that Mr Robinson may have made a minor contribution to the incident.

Taking these matters into account, we accordingly allow a discount on penalty and set the suspension at four days.  Ms Williams’ suspension will start at the conclusion of racing on 3 October 2009, and finish at the conclusion of racing on 23 October 2009.  This will encompass meetings at Gore, Otago, Ashburton and Wyndham.

We record that we questioned Ms Williams as to where she might be riding in the next month or so, and although she has, from time to time, ridden in the North Island, she does not have any riding engagements in the near future, in the North Island.  She rides primarily in the South Island.
