An information was filed following race No.9 and the informant Mr.J.M.Muirhead alleged that Mr. A Grayling was in breach of Rule 869 (3) (b) in that horseman Mr.A.Grayling, drove Jonny Wilkinson carelessly

An information was filed following race No.9 and the informant Mr.J.M.Muirhead alleged that Mr. A Grayling was in breach of Rule 869 (3) (b) in that horseman Mr.A.Grayling, drove Jonny Wilkinson carelessly causing his own horse to break when contesting a position with Matai Al ( Mr. A.G. Herlihy)with 800 meters to run and as a result Jonny Wilkinson was pulled up.

Mr.Grayling was present at the hearing of this information and admitted the breach of this rule.

Mr Muirhead showed the video of this incident and this showed Mr.Grayling contesting for a position when he was not in a position to do so. Mr. Grayling’s horse broke from its gait and was pulled up.

Submissions were heard on penalty from Mr.Muirhead and Mr. Grayling’s, driving record was produced for perusal. Mr.Muirhead sought a fine in the region of $500.00 or a two day suspension of Mr.Grayling’s horseman’s, licence. Mr. Muirhead stated that this was Mr.Grayling’s second breach of this rule in recent months which was confirmed by the print out on Mr.Grayling’s driving record.

Mr Grayling did not wish to be suspended as he had upcoming drives and preferred a fine on this occasion.

Decision And Reasons.

Having taken into account that Mr. Grayling has admitted the breach of this rule and also the fact that this is the second breach of this rule in the last few months by Mr. Grayling a fine of $500.00 was imposed on this occasion.

Mr.Grayling was advised that if he were to appear before a Judicial Committee in the near future for a breach of this rule a lengthy suspension may well be imposed.
