Following the running of Race 7, Alabar Kaikoura Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw “used his whip excessively over the final stages of the race whilst driving KEEPRIGHTONDREAMING”.



Following the running of Race 7, Alabar Kaikoura Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw “used his whip excessively over the final stages of the race whilst driving KEEPRIGHTONDREAMING”.

Mr Walkinshaw was present at the hearing of the information and admitted the breach. He waived the right to be assisted by a senior horseman at the hearing. The breach was found proved.

Mr Escott showed a video replay of the final 400-500 metres of the Race. He alleged that Mr Walkinshaw hit his horse 10 or 11 times prior to the straight entrance. In the home straight, he hit the horse a further 17-18 times.

Mr Escott informed the Committee that Mr Walkinshaw had been fined $350 for excessive use of the whip on 23 November 2007. Mr Escott submitted that the Committee should take into account the following matters:

--

1.      Mr Walkinshaw’s guilty plea;

--

2.      The status of the Race (Group 2) and the stake payable ($50,000); and

--

3.      The previous breach.

--

Mr Escott recommended a fine of $350. Mr Walkinshaw had no comment to make on the Stipendiary Steward’s submissions and had no submission to make in relation to penalty.

In arriving at penalty, the Committee took into account the submissions of Mr Escott and also that many of the strikes on the horse were quite forceful. In the Committee’s view, the breach was at the upper end of the scale.

Mr Walkinshaw was fined the sum of $350. The Committee records that, if Mr Walkinshaw breaches the excessive use of the whip again in the future, he can expect to receive a period of suspension.
