Information No. 7152 was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr P T Holmes, alleging that Mr Laking “allowed himself to be engaged for WALKINGONTHEMOON (in Race 4, CRT Feedbarn/McMillans Equine Feed Rating 70) when he could not make the contract weight”.

Mr Holmes had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The charge was found proved accordingly.

Rule 520 provides as follows:
--(4) Every rider commits a breach of these Rules who:
--(c) wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse.

Mr Ching informed the Committee that the Stewards had been approached by the Clerk of Scales prior to Race 4 and advised by him that Mr Holmes, the rider of WALKINGONTHEMOON in that Race, was 0.75kg over the carded weight (55.5kg) for his ride on that horse. This was verified by the Stewards and Mr Holmes was replaced on WALKINGONTHEMOON by T R Moseley.

Mr Ching explained that Mr Holmes does have problems with his weight. However, it is not acceptable for a horse to race carrying overweight when there are suitable riders available who can make the weight, he said.

Mr Holmes had been fined the sum of $200 at Winton on 17.9.08 for a breach of the same Rule so his record was clear over the last 6 months. Mr Ching recommended a fine of between of $150 and $250.

The Committee took into account Mr Holmes’ admission of the breach and that he was having problems with his weight but had, clearly, been making an effort to get his weight under control.
----
Mr Holmes was fined the sum of $200.
