Information 40633 requesting a ruling in relation to Rule 865(A) of the Rules of
Racing in that the barrier gate of "Jury's Out" did not open with the others, and
whether the horse "Jury's Out" received a fair start.
The Facts:
--Immediately after -the running of Race 9, The Essential Linen Easter Stakes, the
trainer of horse number 2 "Jury's Out", Mr Howarth, requested a ruling from the
Judicial Committee with regard to the failure on the part of the barrier gate of "Jury's
Out" not opening simultaneously with the other barrier gates. He sought a ruling as to
whether or not the horse "Jury's Out" received a fair start in terms of Rule 865(A) of
the Rules of Racing.
That Rule reads:
--"If, in the opinion of the Judicial Committee, a horse does not finish in a
dividend bearing position, was prevented from taking an effective part in a
race owing to the mechanical failure of starting stalls, and that such
occurrence materially prejudiced the chances of that horse, the Judicial
Committee may declare such horse to be a non starter."
We viewed the video evidence of the start and also heard from Mr D Walker, the
jockey of "Jury's Out". He told the hearing that the barrier gate did not open
simultaneously with the other barrier gates, and that his horse effectively forced its
way through and attempted to do so on two occasions. Mr Howarth also advised the
Committee that "Jury's Out" has never missed a start in its racing career. This was
the 47th start of the horse.
DECISION
--In all of the circumstances, we are clearly of the opinion that the horse was prevented
from taking an effective part in the race owing to what was obviously a mechanical
failure of the starting stalls, and as a consequence, "Jury's Out" is declared to be a
non-starter and all bets placed on the horse are to be refunded.
