Mr Oatham said Mr Waddell’s agent phoned in to say Mr Waddell could not make the

Mr Waddell said he had spent a lot of time in the sauna and he was confident of making the weight. He said he still honoured his commitment to a ride in the last race by turning up for that ride, which was at a weight he could make.

Mr Oatham said Mr Waddell had a history of weight problems with 3 previous charges, but this was his first for some time. He submitted a $200 - $300 fine would be appropriate.

Mr Waddell had nothing further to add.

PENALTY:
--The Committee considered all submissions and before imposing a penalty considered Mr Waddell’s record and his guilty plea. While imposing a $200 fine on this occasion, it was impressed on Mr Waddell to be more diligent on accepting mounts he may have trouble fulfilling.
