An information was filed alleging a breach of the driver notification regulations.   The informant being Mr. J M Muirhead, and the defendant being Mr. W Higgs, licenced trainer.

An information was filed alleging a breach of the driver notification regulations.   The informant being Mr. J M Muirhead, and the defendant being Mr. W Higgs, licenced trainer.

The information stated that Mr. W Higgs was late notifying a change of driver for Totally Different. Mr. T Woodward taking the drive. Mr. Higgs did not admit the breach and was present at the hearing of this information.

Mr. Muirhead opened his case and advised the Judicial Committee that Mr. Higgs was one day late in advising his drivers.

Mr. Higgs argued that he had always waited to see how his horses worked in the week leading up to a race and he contended that he was given some leeway in the south island when advising drivers. The chairman asked for a copy of the program as advertised in the Harness Racing Weekly this was produced and this clearly showed the time for driver declarations was as Mr. Muirhead had stated

Having taken into consideration the submissions made by Mr. Muirhead this judicial committee finds the breach of the driver notification regulations proven .

We find that Mr. Higgs had no reason not to notify his drivers on time as it was widely published in the Harness Racing Weekly and on the internet as to the time for notifying a driver.

--

Mr. Higgs was fined the sum of $50.00 in this instance.
