Information 7778 alleged a breach of Rule 871(1)(d) in race one by jockey A C Peard for shifting outwards on ALLYMOOR when not sufficiently clear of SISTINE (P Holmes) taking that horse's rightful line of running. The breach was admitted.

The incident was demonstrated on videos by Stipendiary Steward J P Oatham pointing out the outward movement of 1? - 2 horse widths onto Mr Holmes affecting his mount over several strides when not sufficiently clear.

Mr Peard asked apprentice jockey P Holmes to confirm whether there had been any contact or call from him. He agreed there was no contact and he did not call. He also confirmed his mount had a tendency to react by moving outwards before its line had been taken. However, all parties accepted Mr Peard had taken Mr Holmes' line and was not clear when doing so.

Summing up Mr Coles submitted the video evidence was clear, but he agreed the breach was at the lower end of the scale and could be treated as an error of judgement by Mr Peard. He confirmed that Mr Peard had two charges this year, one in February and the other in March, but given he was riding regularly could be given credit for a good record, although he believed a suspension should be considered taking these things into account.

The Committee after taking these things into account ordered that a suspension for three days should be imposed from the conclusion of racing at Paeroa on 8 November until the end of racing on 14 November next; the meetings involved being Te Rapa, Tauherenikau and Otaki.
