Stipendiary Steward, Mr S Larkins, said that Mr G Smith started his horse from the incorrect barrier position.
| -- DECISION AND REASON ----Stipendiary Steward, Mr S Larkins, said that Mr G Smith started his horse from the incorrect barrier position. CEE H BEE drew Unruly 1 on the front. The rule states that a horse drawn unruly from a mobile shall start ?from the second line no closer in than barrier position 5.? ----Assistant Stipendiary Steward, Mr N McIntyre, who watched the race from the viewing tower immediately behind the start had an unobstructed view and said that Mr Smith started no wider that No.4. Video evidence substantiated this. Mr Smith said he was back a couple of lengths, and did follow No.5 up but thought he started between barriers 4 and 5. He said he settled back to last and gained no advantage and did not inconvenience any other runner. Horseman, Mr Williamson, backed up these points and said even if he had started 3 carts wider there would have been no change to the placings. Mr Smith also said it was the horse's first mobile start and he did not want to excite him. ----Mr Larkins then in rebuttal stated the rule does not say anything about gaining an advantage. It simply states an unruly horse from the mobile shall start from behind barrier 5 or wider. He also felt the camera angle would have made Mr Smith's position appear more favourable than it was. ----Decision ----The Chairman stated that he must agree with Mr Larkins and find that the rule says SHALL start from the second line NO CLOSER THAN IN BARRIER POSITION 5. ----As it is clear from both spoken and video evidence that Mr Smith's horse began from behind barrier position No.4, the horse CEE H BEE, No.12, was disqualified. ----Judge's Placings: 4-12-10-6-1-11 ----Amended Placings: 4-10-6-1-11 |
