Decision:

An information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr S J Kennedy, alleging that Mr Kennedy, as the trainer of SNOW STORMER, ASMAHAN and MISS ITALY, acceptors for Races 1, 3 and 5 respectively, and BLACK CAT and MAGGIORE, acceptors for Race 9, he failed to declare riders for those runners by the required time.

An information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Trainer, Mr S J Kennedy, alleging that Mr Kennedy, as the trainer of SNOW STORMER, ASMAHAN and MISS ITALY, acceptors for Races 1, 3 and 5 respectively, and BLACK CAT and MAGGIORE, acceptors for Race 9, he failed to declare riders for those runners by the required time.

Mr Kennedy had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The breach was found to be proved.

Mr Ching informed the Committee that Mr Kennedy had advised riders for the horses at 4.45pm on Wednesday, 27 February, after a reminder from the National Racing Bureau. The time for declaration of riders was 4.00pm on that day. Mr Kennedy’s explanation was that he had misread the programme. Mr Kennedy had been fined $50 on 9 January 2008 at Kumara for late declaration of a rider. Mr Ching said that the usual fine for a breach of the Rule was $50 per horse but said that he would leave it to the Committee to determine the fine on this occasion.
