Following Race 6 an information was filed by Stipendiary Steward Mr J Oatham pursuant to Rule 871(1)(d), when it was alleged that Ms J Smellie, rider of DISCOVERY BAY shifted in when not clear

DECISION AND REASON:

--

Following Race 6 an information was filed by Stipendiary Steward Mr J Oatham pursuant to Rule 871(1)(d), when it was alleged that Ms J Smellie, rider of DISCOVERY BAY shifted in when not clear causing tightening and a resultant check to WILD CAT (C Ormsby), near the 600 metre mark.

Ms Smellie pleaded guilty and was represented by Trainer, Mr G Newham.

Mr A Coles demonstrated the video films and showed that at the 600-metre mark Ms Smellie drift off the rail leaving a gap of at least one horse width. This allowed WILD CAT (C Ormsby) to go up on the inside of DISCOVERY BAY to be approximately a half-length behind. Ms Smellie then came back into the rail, tightening WILD CAT who was checked for several strides.

Mr Newham said DISCOVERY BAY appeared to be hanging out slightly and when Ms Smellie came back in she did not realise Mr Ormsby was on her inside. He asked the committee to consider this was her first offence and also her inexperience.

Mr Oatham said it was Ms Smellie's first offence and was really an error of judgement due to her inexperience, however, the interference was significant and he believed a suspension was necessary but at the lower end.

The committee considered all the evidence and submissions on penalty and took into account the following -

  5. Her degree of carelessness.
  6. --
  7. Her guilty plea.

Accordingly, a suspension was imposed to start after racing on the 1st of December 2007 and conclude after racing on the 8th of December 2007 (3 days).
