Following the running of Race 7, Mr Collins was charged with careless riding arising from an incident shortly after the start when Miss is Brash suffered interference. Mr Collins admitted the breach which was therefore established as being proved.

Mr Goodwin produced evidence to show the Committee that Werdna, ridden by Mr Collins, started from a wide draw. After the start Mr Collins angled the horse across the field towards the rails. That line took him across the line of Miss is Brash although he was not sufficiently clear of that horse and resulted in that horse clipping the heels of Werdna and losing several lengths.

Mr Goodwin said that Mr Collins has not previously faced a charge of careless riding for some 3-4 years. However, this charge was serious and warranted a term of suspension.

The Committee accepted that this charge needed to be viewed seriously. Miss is Brash suffered severe interference and the incident could easily have resulted in an accident. For that reason the Committee would be imposing a term of suspension. However, it gave Mr Collins full credit for his excellent race riding record to reduce the suspension to the minimum it considered appropriate. Mr Collins was suspended from after close of racing on Sunday 17 April 2005 until after close of racing on Saturday 24 April 2005.
