Information No. 65180 alleges that Mr A K Black, junior horseman, driver of CUT AND STYLE, drove carelessly, with approximately 500 metres to run.
--At the conclusion of Race 3, the Centrepoint South City Liquorland Pace, a protest was lodged by Stipendiary Steward Mr P T Knowles, alleging under Rule 869(8)(b) that with approximately 500 metres to run, CUT AND STYLE, number 11, driven by Mr A K Black, shifted ground inwards when insufficiently clear of ODIN?S SON driven by Mr B J Morris, causing that horse to break, losing all chance.
--Stipendiary Steward Mr Allison used several video clips to highlight the alleged interference clearly, in his opinion, stating that Mr Black's inward movement had tightened ODIN?S SON and left Mr Morris, its driver, no options and nowhere to go causing that horse to break and in turn checking ANTHONY SHAUN, driven by Kirsten Barclay, with this horse also breaking and losing its chance.
--Mr Morris, driver of ODIN?S SON, stated that his horse had nowhere to go, with the inward movement from CUT AND STYLE forcing him into very tight racing quarters. Mr Morris also stated that he yelled out to Mr Black to give him room but to no avail as Mr Black did not respond verbally or by his actions.
--Mr Jones, representing Mr Black, stated that Mr Black was entitled to be racing in the three or four wide position, and that CUT AND STYLE may have hung in momentarily, giving the impression of moving inwards. Mr Jones also questioned the distance between the third placed horse, CUT AND STYLE, to the horse that was allegedly interfered with, ODIN?S SON. This was confirmed as 13 lengths.
--Mr Adams, trainer of CUT AND STYLE, and Mr O?Connor, owner of CUT AND STYLE, confirmed Mr Jones' opinions, surrounding the alleged interference.
--Mr Knowles also referred to Rule ? Easing Down Regulations ? clarifying for Mr Jones aspects of his points regarding Mr Black's movement forward, and easing off.
--In my opinion, interference has occurred to ODIN?S SON as a result of CUT AND STYLE moving inwards when clearly not sufficiently clear and, as a result, the protest is upheld.
