Decision:
Following the running of Race 7, Next Friday’s South Island Bloodstock Sale Premier, an information was filed by Chief Stipendiary Steward, Mr R Sanders, against Licensed Apprentice Jockey, Mr S Muniandy, alleging a breach of Rule 871 (1) (d) – careless riding – in that “near the 800 metres [Mr Muniandy] allowed his mount DISCOVERY BAY, to shift taking MADAME RIO (K Williams) inwards causing FONEELEVEN (D G Bradley) to be checked off the heels of LA VAZZA”.

--The information was filed and served on Mr Muniandy on raceday and was adjourned and heard at the meeting of Canterbury Jockey Club on Wednesday, 5 August 2009.
--Mr Muniandy was present at the hearing of the information and was assisted by Licensed Trainer, Mr S C Anderton. Mr Muniandy admitted the breach which was found proved accordingly.
--Mr Sanders showed video replays of the incident after approximately 400 metres of the 1200 metres event. He pointed out the three horses involved – DISCOVERY BAY, MADAME RIO and FONEELEVEN – and showed Mr Muniandy allow his mount to shift in forcing Mr Bradley to check. Mr Sanders said that Miss Williams had told the Stewards she called to Mr Muniandy several times and Mr Muniandy could be seen to look to his inside several times.
--Mr Sanders said that Mr Muniandy’s record showed that he had the following previous breaches of the careless riding Rule:
7.7.09 Ashburton 4 days
7.3.09 Otago 4 days
21.11.08 Winton 3 days
The interference to Mr Bradley’s mount was in the “middle to low range”. Mr Muniandy had made “a slight error of judgement”, Mr Sanders said, and given that Mr Muniandy had not long returned from a 4-days suspension, his riding would not be helped by another long suspension. He recommended a suspension of 3 days – 4-days. A suspension for 4 days would be a month. Mr Sanders said that he would take steps to ensure that Mr Muniandy received some “one-on-one tuition” with his riding to help him eliminate such minor errors of judgement.
--Mr Anderton said that Mr Muniandy had made an error of judgement. He may have been under some pressure from the horse on his outside for 3-4 strides before the incident and had himself come across three strides too early. He had admitted the breach. Mr Anderton said that he would arrange for Mr Muniandy to get help with his riding.
--Mr Anderton said that Mr Muniandy had an engagement to ride on the final day of the meeting on Saturday, 8 August.
--The Committee accepted Mr Sanders’ submission that a 3-days’ suspension was appropriate having regard, in particular, to Mr Muniandy’s admission of the breach and to the minor nature of the breach and having regard to Mr Sanders’ submissions and the desirability of assisting Mr Muniandy to continue riding and to eliminate the errors of judgement from his riding. The Committee was prepared to show leniency to Mr Muniandy on this occasion having regard to the submissions of Mr Sanders. The Committee was aware of Mr Muniandy’s record over the previous 12 months’ period but, notwithstanding that, imposed a penalty of a 3 days’ suspension, such suspension to run from after the close of racing on Saturday, 8 August 2009 up to and including Friday, 28 August next.
