Decision:

Following race 7 an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Williamson, alleged that near the 1100 metres GOLDEN SPUR (N Collett) shifted in dictating KEEP THINKING (L Innes), ROAMING (J Collett) and LADY ISTIDAAD (S Collett) into the line of SILK ROAD (C Ormsby) who was checked losing ground.



Following race 7 an information was filed pursuant to Rule 638(1)(d).  The informant, Mr Williamson, alleged that near the 1100 metres GOLDEN SPUR (N Collett) shifted in dictating KEEP THINKING (L Innes), ROAMING (J Collett) and LADY ISTIDAAD (S Collett) into the line of SILK ROAD (C Ormsby) who was checked losing ground.

Miss Collett admitted the charge and was represented by trainer, Mr G McCrae.

Mr A Coles demonstrated the video films which clearly showed Miss Collett angle her mount, GOLDEN SPUR, inwards from a wide barrier and dictate the line of the runners on her inside.  Mr Coles said Miss Collett was a bare length clear of Mr Innes when she moved in.  He did say that there was slight outward movement from Mr Du Plessis riding ALLTHEANGELS which may have contributed to the incident.  He also said Mr Ormsby’s mount may have over-reacted to the tightening.

Miss Collett had nothing further to add.

Mr McCrae said Mr Du Plessis did move out slightly and that Mr Ormsby was not going well enough which made the interference look worse than it was.

PENALTY SUBMISSIONS:
Mr Williamson said Miss Collett had three previous charges in the last 12 months, but nothing for the last seven months.  He said it was an outstanding record.  He said the interference was at the high end, but because of mitigating factors believed Miss Collett’s carelessness was at the lower end.

Miss Collett said she only had commitments until 28 November 2009, but intended to ride in the South Island next week.

PENALTY:
The Committee considered all evidence and submissions as presented.  Mitigating factors considered were Miss Collett’s guilty plea and her excellent record.  However, the aggravating factor in this case was the tightening received by several runners on Miss Collett’s inside, caused by her inward movement when insufficiently clear.  The Committee considers, however, her carelessness was at the low end.  Accordingly after taking all the above factors into account we impose a suspension on Miss Collett from riding in races which is to start after racing on 28 November and conclude after racing on 4 December 2009 (4 days).
