Mr Goodwin (Stipendary Steward) the informant read the relevant rule and called as witnesses, the two riders whose horses were stranded in the barriers namely T Bishop the rider of Jularee and D Walsh the rider of Lite Leigh he also called the starter Mr B Clement and the Clerk of the Course Miss T Egan and her assistant Miss J Lawrence.

Facts

--

The abovementioned horses Jularee and Lite Leigh were left stranded in the barriers when the gates opened, their respective gates remained closed.  Miss Bishop and Mr Walsh told the Committee the possible and most likely reason their gates did not open was that Jularee had anticipated the start and charged the gates.  Mr Walsh also told the Committee he called loudly “FALSE START” when the starter released the rest of the field.

Mr Clement the starter confirmed when Jularee and Lite Leigh’s barriers did not open he (a) waved his flag and (b) pushed the siren button confirming a false start.

Miss Egan and Miss Lawrence (CLERKS OF THE COURSE) said they heard the siren sound and saw the starters flag raised for a false start (they were some 100 metres from the start.)

Miss Lawrence rode alongside the field calling false start some of the jockeys she clearly heard calling false start but others rode on as if in an ordinary race.

Decision & Reasons

--

Having heard all of the foregoing and taking into account that part of rule 864 which states the starters decision as to whether it is or is not a false start, the Committee had no hesitation in declaring the race VOID as the starter had declared a false start.
