Decision:

The protest concerns horse No 3 placed 10th by the Judge against horse No 10 placed 1st by the Judge.



The protest concerns horse No 3 placed 10th by the Judge against horse No 10 placed 1st by the Judge.

The alleged interference occurred approximately 500 metres from the finish.

Present at the hearing were Miss N Chilcott trainer of horse No 3 GRINNING AT U and that horse's driver Mr N Chambers.

Mr WP Fleming the OWNER/TRAINER of horse No 10 ROMANTIC STAR that horses driver Mr A Sharpe and Mr T Shaw (representing Mr Sharpe.)

The rule was read and those present acknowledge they understood same.

--

A film was then shown of the alleged incident and interpreted by Mr Escott.

--

When questioned Mr Sharpe said he felt Mr Chamber's horse hit his wheel as he had moved outside of same.

Miss Chilcott said her horse GRINNING AT U had a puncture mark on its leg, caused by striking the sulky of ROMANTIC STAR (this was confirmed by the Stipendiary Stewards).

The Stipendiary Stewards were of the view that the interference caused by ROMANTIC STAR to GRINING AT U had caused that horse to break from its gait and this extinguished any chance that GRINNING AT YOU may have had.

When arriving at a decision the Chairman took into account Mr Sharpe's admission of interference to GRINNING AT YOU, also the fact that the interference to GRINNING AT U was not minor and exercised his discretionary powers and disqualified ROMANTIC STAR.

--

The amended placings were as follows:

--
