An Information was lodged by Stipendiary Steward Mr JM Muirhead pursuant to Rule 858(a)(b) against Mr W Higgs (represented by Caretaker Trainer Mr CE Sprott) on the grounds that their horse Village Sarti was presented late into the assembly area

An Information was lodged by Stipendiary Steward Mr JM Muirhead pursuant to Rule 858(a)(b) against Mr W Higgs (represented by Caretaker Trainer Mr CE Sprott) on the grounds that their horse Village Sarti was presented late into the assembly area and then onto the race track in that it went onto the race track with nine minutes to race start time.
----Mr Sprott on behalf of Mr Higgs did not admit the breach and was present at the Hearing.
----Mr Muirhead advised that he was in the Parade Ring (assembly area) prior to Race 1 and noted that Village Sarti was not only late into the Parade Ring but did not go onto the track until nine minutes prior to race start time. Mr Muirhead confirmed the time against the time displayed by the TAB on the Racecourse Display Board.
----Mr Sprott said that he was the notified Caretaker Trainer but that he was not present for Race 1 because he was bringing another horse. Mr Sprott advised that Village Sarti had been stabled at the stables of Mr Todd Mitchell at Cambridge and had been floated to the course with Mr Mitchell's other horses.
----Mr Sprott acknowledged that the horse was late into the Parade Ring and apologised for any inconvenience caused. He advised the Committee that Mr Mitchell's stable assistants had some difficulty in gearing up Village Sarti because it was giving them bother. Mr Sprott did acknowledge however that he could only go on the evidence given by Mr Muirhead.
----Mr Muirhead further advised that no notification had been given to the Parade Ring Steward that there was any difficulty in gearing up Village Sarti.
----In respect to penalty Mr Muirhead said that the Rule was there for a reason and that a fine of $100.00 - $200.00 was recommended. Mr Sprott did not think that a fine was warranted.
----The Committee considered all of the evidence given and found that the charge had been proven and accordingly imposed a fine of $150.00 on Mr Higgs.
