Following the running of Race 6, the Shepherd & Kime Ltd Mobile (PBD) Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr R. H. Jenkins, the driver of “Our Orb” (6), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively in the run home.

Following the running of Race 6, the Shepherd & Kime Ltd Mobile (PBD) Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr R. H. Jenkins, the driver of “Our Orb” (6), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively in the run home.

Mr Jenkins had indicated on the information that he admitted this breach of the Rule and also that he did not wish to attend the hearing.

Mrs Williams gave evidence and used video coverage to show that Mr Jenkins had used his whip on about 26 occasions in the run home as set out in the Information.

In relation to penalty Mrs Williams advised that Mr Jenkins had no relevant previous convictions, and had admitted the breach. A fine of $200-00 was recommended.

Taking into account the matters put forward by Mrs Williams I was satisfied that a fine of $200-00 was appropriate in the circumstances. Accordingly Mr Jenkins was fined the sum of $200-00.
