Decision:

Following the running of Race 4, the Tool King South Fillies & Mares Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr C. T. Woodward Jnr., the driver of “Midewewin” (14), alleging a breach of Rule 869(2)(a) in that he used the whip excessively in the run home.

Following the running of Race 4, the Tool King South Fillies & Mares Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr C. T. Woodward Jnr., the driver of “Midewewin” (14), alleging a breach of Rule 869(2)(a) in that he used the whip excessively in the run home.

Mr Woodward had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.  He also agreed that he understood the charge, the Rule it was brought under and the “Use of Whip” guidelines.

Mr McIntyre used video coverage to show that Mr Woodward had used his whip on about 24 occasions in the run home.  Mr Woodward said that he hit the dust sheet on most occasions, but agreed that he was in breach of the guidelines and the Rule.

Mr McIntyre advised that Mr Woodward had one previous relevant conviction at the Akaroa Trotting Club’s meeting on 30 March 2008 when he had been fined $200-00.  Mr McIntyre also advised that Mr Woodward preferred a suspension to a fine in this case, and recommended a 2 – 3 day suspension.

There was a discussion as to what race meetings Mr Woodward would be driving at, and he advised that he could be driving at any of the South Island meetings.

I was satisfied that a 2 – 3 days suspension was an appropriate penalty in this case.  Mr Woodward’s Open Horseman’s licence was therefore suspended from after the conclusion of racing on 30 December 2008 until after the conclusion of racing on 3 January 2009, which is effectively a 3 days suspension.
