Decision:
Following Race 1 an information was filed pursuant to Rule 871 (1) (d). The informant Mr A Coles alleged that Mr M Cropp, rider of VOLCANIC ACTIVITY, permitted his mount to shift inwards near the 1300 metres when not sufficiently clear of ARNIE (P Turner) who was forced inwards causing severe interference to AIR CADET (S Phelan) and POTHEEN (A Ihaka).
Following Race 1 an information was filed pursuant to Rule 871 (1) (d). The informant Mr A Coles alleged that Mr M Cropp, rider of VOLCANIC ACTIVITY, permitted his mount to shift inwards near the 1300 metres when not sufficiently clear of ARNIE (P Turner) who was forced inwards causing severe interference to AIR CADET (S Phelan) and POTHEEN (A Ihaka).
--Mr Cropp admitted the breach and was represented by Trainer Mr L Noble.
--Mr Oatham demonstrated the video films which showed VOLCANIC ACTIVITY, racing ungenerously, begin to move in approaching the 1300 metre mark. Mr Oatham said Mr Cropp did straighten during the first inward movement but then allowed his mount to move in sharply when only ½ a length clear of ARNIE (P Turner). This caused ARNIE to be forced inwards resulting in severe checks to AIR CADET (S Phelan) and POTHEEN (A Ihaka) who clipped heels and nearly fell.
--Mr Cropp said his mount was hanging and over-racing and he moved to get a better position. However he realized he caused problems to some riders on his inside.
--Mr Noble said it was evident Mr Cropp’s mount was over-racing and initially Mr Cropp tried to straighten. However Mr Cropp did plead guilty which Mr Noble asked the Committee to consider.
--PENALTY SUBMISSIONS
--Mr Coles said 3 horses received interference with 2 runners in particular being severely inconvenienced. He said the Jumps day on 27 September was the last opportunity for Jumps riders when Mr Cropp could obtain rides. He submitted a suspension and a fine of $500 - $700 would be appropriate.
--Mr Cropp or Mr Noble had nothing to add.
--PENALTY
--The Committee carefully considered all evidence and submissions before imposing a fair and correct penalty. Mr Cropp’s guilty plea was the only mitigating factor. This had to be balanced against the severe checks received by 2 horses and Mr Cropp’s level of carelessness which we consider to be in the mid range.
--As the Jumps riders’ season finishes on Sunday 27 September 2009 the Committee is forced to impose a fine and a suspension. Accordingly we impose a suspension to start after racing today, 23 September 2009 and conclude after racing on 27 September 2009 (1 day). In addition we impose a fine of $500.
