As the result of an incident in Race 2 at the Canterbury Jockey Club’s meeting on Saturday 15th November 2008, Ms D Johnson, Apprenticed Jockey, was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

It was alleged that she allowed her mount “Menalaus” to shift inwards causing “Magnanimous” (L Innes) to check near the 1300 metres mark. 



As the result of an incident in Race 2 at the Canterbury Jockey Club’s meeting on Saturday 15th November 2008, Ms D Johnson, Apprenticed Jockey, was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

It was alleged that she allowed her mount “Menalaus” to shift inwards causing “Magnanimous” (L Innes) to check near the 1300 metres mark.

The evidence was that Ms Johnson was racing towards the rear of the field, two out from the fence.  She moved inwards into the path of “Magnanimous” when not her own length and another length clear.  The very nature of that fact would seem to suggest immediately that she rode carelessly.  Mr Innes had to check his mount momentarily, to avoid coming into contact with Ms Johnson’s mount’s heels.

Mr George said that she was in trouble with the horse directly in front of her, which drifted back to the field after the start, and maintained that Ms Johnson should have stayed where she was and not elected to come across the path of Mr Innes.

However, Ms Johnson said she had no option but to move ground as she did.  She said it was hard to keep a 500 to 600 kilogramme horse off the heels of another.  Perhaps she could have gone to the outside.  However, she looked inwards and, in her mind, she perceived that there was sufficient room.  Mr Innes was momentarily inconvenienced, but not at any stage, in our opinion, placed in danger of a fall.

Having given consideration to all of the evidence, we need to be satisfied that Ms Johnson rode carelessly.  We do not believe that the evidence is sufficient to satisfy us in that regard, and therefore the charge is dismissed.
