DECISION AND REASONS:
--Following the running of Race 10, Easylawn?Centrefold Flashings Ltd Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against SCHERGER REIN (R D Holmes) and SPIRIT OF ASHLEY (K M Barron), placed 2nd and 5th respectively by the judge, on the grounds of interference to HINT OF A TINT (C T Woodward), placed 15th by the judge, with 200 metres to run.
----Mr Woodward stated that he had been parked and that, at the 200 metres, his horse was "flat" and "battling". The two horses, SCHERGER REIN and SPIRIT OF ASHLEY, were in front of him at that point. Mr Woodward said that he was slowly running out of room and was trying to get out of the way of those two horses. When asked by McIntyre, Mr Woodward said that HINT OF A TINT was not going to run in a dividend or stakes bearing position and, therefore, he did not believe that his chances had been affected as a result of the interference received.
----Mr B D Williams showed a video replay of the final 300 metres of the race. He pointed out HINT OF A TINT become tightened with approximately 200 metres to run and break. He stated that, in his view, there had been some movement from both horses which resulted in the tightening to HINT OF A TINT.
----Mr Holmes acknowledged that that his horse had "lugged in" but had nevertheless maintained a "fair line". He stated that he heard a "bang" after he passed HINT OF A TINT which was that

horse striking the wheel of SPIRIT OF ASHLEY. Mr Holmes said that he had not made contact
--with HINT OF A TINT.
----Mr Barron stated that his horse had run around. He stated that the leader, CULLENS REIGN, had run out and his horse had attempted to follow it. He submitted that any outward movement was slight.
----The video evidence was inconclusive due to the lack of a true head-on video replay, a point which had been made by Mr Barron and conceded by Mr McIntyre. It, nevertheless, did appear that HINT OF A TINT had received interference from either or both of SCHERGER REIGN and SPIRIT OF ASHLEY. It was difficult to determine the amount of movement by those two horses or to apportion blame between them because of the lack of a head-on video replay. However, it was clear to the Committee from the evidence of Mr Woodward, which was unequivocal, and from its own observations from the video replay that HINT OF A TINT was weakening at the time it received the interference and that it would not, in any event, have finished in a dividend or stakes-bearing placing. Therefore, the Committee was not satisfied that the chances of that horse were affected as a result of the interference.
----Accordingly, the protest against both SCHERGER REIN and SPIRIT OF ASHLEY was dismissed and it was ordered that the judges placings for the race should stand.
