Mr Knowles, stipendiary steward, laid an information after race 3 alleging that contrary to rule 869(2)(a), Mr Scobie, driver of CRUSIN FORALIVIN used the whip excessively in the run home. Mr Scobie admitted the breach and indicated both on the information and verbally to the Committee that he did not wish to be present at the hearing. He stated he trusted Mr Knowles to put the matter fairly.
--As Mr Scobie has admitted the breach I find the charge proved. Mr Knowles has demonstrated on the video 30 plus strikes of the whip in a continuous fashion over approximately the final 175 metres of the race. Mr Knowles produced Mr Scobie's record which showed 2 breaches of this rule in the past 6 months. Mr Scobie was fined $250 in November 2006 and suspended for 2 days in March 2007. Mr Knowles asked for a suspension of 5 or 6 days.
--Mr Scobie's ready admission of the breach is given weight as a mitigating factor. However, I agree with Mr Knowles that a deterrent penalty has to be imposed. This is Mr Scobie's 3rd breach of the excessive use of the whip rule in the past 6 months. Mr Scobie has clearly not learned from either the imposition of a fine or a suspension. I believe the deterrent element is best found in the circumstances of this case in a combination of a suspension and a fine. Mr Scobie is suspended from the end of racing this evening up to and including 27 May and is fined the sum of $250.
