DECISION AND REASONS:
--Following the running of Race 4, The Realtor Handicap Trot, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against DEL?S HOOF N IT (G W Hunt), placed 3rd by the judge, on the grounds of breaking from its gait and being lapped on by the 4th horse, JACK THE CAPRICORN.
----Mr Hunt, the part-owner, trainer and driver of DEL?S HOOF N IT, had signed an endorsement "I do not contest the protest" endorsed on the information form and he was not present at the hearing.
----Mrs Williams pointed out on a video replay of the final stages of the Race DEL? S HOOF N IT in the lead and, inside the 50 metres marker, gallop and have to be restrained finishing in 3rd placing but in a break crossing the finishing line, being lapped on by the 4th horse, JACK THE CAPRICORN. The official margin between 3rd and 4th was a neck. The photo finish was also produced to the Committee.
----The Committee was satisfied that DEL?S HOOF N IT went into a gallop inside the final 50 metres of the Race, when leading, and was not in its correct gait when its nose reached the finishing line and, further, that it was lapped on by the 4th horse, JACK THE CAPRICORN. The Committee was required in terms of Rule 870 (4) to relegate DEL?S HOOF N IT behind JACK THE CAPRICORN.
----Accordingly, the protest was upheld and DEL?S HOOF N IT was relegated from 3rd to 4th placing and JACK THE CAPRICORN was promoted from 4th to 3rd placing. Consequent upon the relegation, the amended placings for the Race are as follows:
--1st 3 Ollie Nova
--2nd 4 Olivia of Kew
--3rd 11 Jack the Capricorn
--4th 9 Del's Hoof N It
--5th 8 So and So.
