Following the running of Race 7, the Clem and Russell Brand Memorial Mobile Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr B. A. Lilley alleging a breach of Rule 864(2)(d). Mr Lilley was represented at this hearing by Mr D. E. Johnston, the part owner and driver of “Here Comes Soky” (7), and he had indicated on the information that he admitted this breach of the rules and he confirmed this at the hearing. Mr Johnston also confirmed that he understood the Rule and the nature of the charge.

Stipendiary Steward Mr Ydgren gave evidence that after the running of the race he noticed that the removable earplugs had not been activated, and it appeared that the cord had been affixed too tightly. Mr Johnston did not contest this evidence.

Mr McIntyre advised that Mr Lilley had no previous relevant convictions and had admitted the breach. A fine of $100-00 was recommended. Mr Johnston had no relevant submissions to make regarding penalty.

I was satisfied that a fine of $100-00 was appropriate in this case and Mr Lilley was therefore fined the sum of $100-00.
