ID: JCA21359

Hearing Type:
Old Hearing

Rules:
871.1.d

Hearing Type (Code):
harness-racing

Decision: --

Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that Mrs L Satherley, the rider of DEE ONE, permitted her mount to shift out near the 200 metres

--

DECISION & REASON:

--

Following race 6 an information was filed pursuant to Rule 871(1)(d) when it was alleged by Mr J Oatham that Mrs L Satherley, the rider of DEE ONE, permitted her mount to shift out near the 200 metres causing a check to SURFERS (D Hain).

--

--

Mrs Satherley pleaded guilty to the charge.

--

--

Mr Coles demonstrated the video films and showed that at the 200 metre mark Mrs Satherley angled her mount out for a run and in doing so took the line of SURFERS ridden by Mr D Hain. Mrs Satherley was not the required distance clear. As a result Mr Hain had to check his mount losing a length or so.

--

--

Mrs Satherley in admitting the breach said that when she looked Mr Hain was 2 lengths away, but she agreed she was not clear when she made her run.

--

--

PENALTY:

--

Mrs Satherley believed the offence was at the lower end of the scale and asked for a fine.

--

--

Mr Oatham produced Mrs Satherley's record which showed 2 charges in the last 12 months. He said it was at the lower end of the scale, but believed a suspension was appropriate.

--

--

The Committee considered all submissions, took into account Mrs Satherley's guilty plea, her record and the nature of the interference. Accordingly we impose a suspension to start after racing on 14 April and conclude after racing on 21 April (3 days).
