DECISION & REASON:

A protest was lodged by the Stipendiary Steward, Mr A R Coles, alleging that ATAPI ridden by Mr G Grylls placed first interfered with the chances of SENORITA IVORY ridden by Miss Lee Rutherford placed third.

Evidence was presented by Mr Oatham, Stipendiary Steward, with the use of the film demonstrating the outward movement of ATAPI at the top of the straight forcing SENORITA IVORY off line outwards two horse widths and making contact three times. This hampered the forward movement of SENORITA IVORY and with a half head margin between second and third affected the chances of SENORITA IVORY finishing in a better placing.

Mr Grylls stated in his evidence that Miss Rutherford did not stop riding and this was noticeable on the back film and that SENORITA IVORY?S chances were not affected. Mr Otto, trainer of ATAPI, supported Mr Grylls' evidence.

Miss Rutherford stated that her chances were affected in that she lost several lengths and that her horse ran on at the finish. Mr Jillings, trainer of SENORITA IVORY, stated that there was no room for Mr Grylls to improve without the sideways push and lost his horse the half head margin between second and third.

The Panel's decision supports the evidence of Mr Oatham and the connections of SENORITA IVORY that the interference caused by ATAPI affected the chances of SENORITA IVORY in that the outward movement prevented SENORITA IVORY from finishing in a better position considering the margin of half a head between second and third. The Panel exercised a discretion to relegate ATAPI behind SENORITA IVORY. The official placings become:
