CHARGES:
--This was a protest by Mr Ydgren against horse number 4, DUNARUNNER, placed 5th by the Judge, on the ground that the horse broke after 300 metres and failed to regain its gait promptly.

Mr Ydgren had Mr McIntyre demonstrate the incident. The video showed that DUNARUNNER, which was leading, broke free of interference and galloped in excess of 150 metres.

Mr Butt, the driver of DUNARUNNER indicated on the information that he did not contest that DUNARUNNER should be disqualified.

REASON(s):
--We have viewed the incident on the video and are satisfied DUNARUNNER broke free of interference and galloped for at least 180 metres. This is in excess of the distance of 150 metres that is referred to in the breaking horse regulations as offering guidance to a Committee as to when a horse has failed to promptly regain its gait.

DECISION:
--We have a discretion to exercise as to whether disqualify DUNARUNNER. In light of the distance over which DUNARUNNER has failed to regain its gait we exercise this discretion and disqualify that horse from 5th placing.
