Decision: Following Race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged that C Ormsby angled BOOKER BEAM out when not clear
Following Race 1 an information was filed pursuant to Rule 871(1)(d) when it was alleged that C Ormsby angled BOOKER BEAM out when not clear tightening UNO MOMENTO which caused a severe check to LORD DONSCHIEF, T Thornton, and FOXY KIWI, N Collett.

Mr Ormsby, who was represented by Mr J Pender, admitted the charge.

Mr A Coles demonstrated the videos. He showed where, as the field left the back straight, Mr Ormsby was positioned on the rails. He then began to improve his position and moved off the rails. In doing so he put pressure on UNO MOMENTO who was entitled to hold her place. The resultant movement caused LORD DONSCHIEF to be severely checked with the resultant interference to FOXY KIWI.

PENALTY: As Mr Ormsby admitted the charge the committee is required to adjudicate in penalty only.

Mr Williamson said that he considered the offence to be at the high end of the scale. He said that although Mr Ormsby had not been charged for a breach of Rule 871 in the last 12 months he asked for a suspension.

Mr Ormsby said that he thought that he was in danger and he reacted to relieve the pressure. He felt that the offence was not as bad as Mr Williamson claimed. He also informed the committee that he had commitments at Matamata and Counties meetings during the next week.

The committee considered :
--1. Mr Ormsby’s good record.
--2. Mr Ormsby’s admission of guilt.
--3. The severity of the interference.
--4. That Mr Ormsby ignored the warning of tightening and continued to ride forward causing the resultant interference.

After due consideration the committee suspends Mr Ormsby from race riding beginning after the finish of racing on 15 October till the after the finish of racing on 27 October 2008 – 8 days.
