Following the running of Race 7 the Stipendiary Stewards lodged information instigating a protest in respect of horse number 5 [Rose Show ? AM Butt] placed 4th by the Judge
| -- DECISION & REASON ----Following the running of Race 7 the Stipendiary Stewards lodged information instigating a protest in respect of horse number 5 [Rose Show ? AM Butt] placed 4th by the Judge on the grounds of interference to Rycol Falcon [J W Smolenski] with approximately 300 metres to run. ----At the commencement of the Hearing Mr Escott briefly summarised the position of the Stipendiary Stewards in saying that Mr Butt [Rose Show] moved out onto Rycol Falcon [Mr J W Smolenski] when insufficiently clear causing the latter horse to break and lose all chance. ----Mr J W Smolenski said with approximately 300 to metres to run Rose Show came out from a trailing position and contacted Rycol Falcon near hind leg. He further said that as a result of the contact, his horse broke and lost all chance. After viewing the video evidence he said that Mr Butt after initialling moving Rose Show out, that horse overreacting and taken hold of and straightened the horse after contact took place. ----Mr B Williams [with the assistance of the video evidence] demonstrated the incident. That evidence showed Rose Show in a travelling position with Rycol Falcon on its outside. She asked the Committee to note Rose Show moving out and coming into contact with Rycol Falcon which is evident from both video angles shown to the Committee. He said that as a result of the interference Rycol Falcon galloped and lost all chance. ----Mr D G Jones said that the contact was slight and that happens often in Races. Mr A M Butt after viewing the video evidence said hat the interference was minimal and that he was uncertain as to whether or not Rose Show made contact with Rycol Falcon. He accepted that Rycol Falcon broke and lost all chance. ----The Committee after giving careful consideration to the evidence presented and submissions of both parties, is of the view that there was interference to Rycol Falcon. The interference was caused by Rose Show and that as a result of the interference Rycol Falcon broke and then lost all chance on the Race. The Committee is further of the view that in all circumstances relegation should occur and accordingly Rose Show is relegated from 4th placing to placing immediately behind Rycol Falcon. The state bearing placing now read 7, 6, 2, 8 and 15. --CHAIRMAN |
