Following Race 10 the Informant instigated a protest alleging that Princess Road (S Saad), placed fourth, interfered with the chances of Katies Dan ( R Norvall) placed fifth – the interference occurring in the final straight.

Mr J Oatham, for the Informant commenced proceedings by reviewing the race video –identifying and detailing the positions of horses involved. He demonstrated that around the 50 meter mark Princess Road, with rider S Saad using the whip, angled out and made contact with Katies’s Dan – causing that horse to move out 2-3 horse widths and in turn cause interference with Star Of Nero (D Johnson) by clipping the heels of her horse. Mr Oatham indicated that at the time of the interference Katies’s Dan was in front of Princess Road and stated that he considered that as a consequence of the interference Katies’s Dan was denied the chance of a better placing.

The representative of Katies’s Dan confirmed that the horse was ahead of Princess Road prior to the interference. The Defendant conceded that interference had occurred but queried whether it warranted relegation. Neither of the jockeys wished to comment.

Making final comment Informant Coles pointed out that after Princess Road began the outward movement the jockey did not stop using his whip, and felt that the interference which followed warranted a change of placings.

The Committee was satisfied that Princess Road did make contact with Katie’s Dan, and that the interference caused to that horse and Star Of Nero was sufficient to affect the chances of Katies’Dan finishing in a better place.

The Committee, in reaching that decision noted the final margin between the two horses - half a length – that contact was made when the inside horse angled out, and that the outside horse was in front at that time.

The Protest was upheld and final placings declared as:

1St – 1 Electrify, 2nd 9 Mia Custode, 3rd 7 Star Of Nero, 4th 6 Katie’s Dan, 5th Princess Road, and 6th Waitui Fox.
