Following the running of Race 1, the Robbie's Bar & Bistro Graduation Series Mobile Pace (Final), an information was laid by Stipendiary Steward Mr S. T. Larkins against Mr C. D. Thornley, driver of Ermis's Flyer (1), alleging a breach of Rule 869(3)(b).
| -- DECISION AND REASONS: --Following the running of Race 1, the Robbie's Bar & Bistro Graduation Series Mobile Pace (Final), an information was laid by Stipendiary Steward Mr S. T. Larkins against Mr C. D. Thornley, driver of Ermis's Flyer (1), alleging a breach of Rule 869(3)(b). The charge was that Mr Thornley drove carelessly with 150m to run when improving into a gap when there was insufficient room, resulting in Ermis's Flyer breaking. --Mr Thornley indicated on the information that he admitted the breach of this Rule and he confirmed this at the hearing. --Video coverage of this incident was shown and it illustrated the matters included in the charge. --Mr Thornley explained that he had tried to take a gap which had closed. --In relation to penalty Mr Larkins advised that Mr Thornley had a clear record for this type of breach, and a fine of $250-00 was recommended. Mr Thornley had no submissions to make with regards to penalty. --Having heard the submissions on penalty we took into account Mr Thornley's clear record and his guilty plea. We were satisfied that the fine recommended was appropriate and Mr Thornley was fined the sum of $250-00. ----
