Decision:

An Information was lodged by Stipendiary Stewards TW Taumanu and JM Muirhead alleging that Junior Horseman O Gillies improved outwards with Nullabor Song forcing Glow (Driver J Dickie)  to race wider on the track with 1300 metres to run and as a result this was a breach of the Pushout Rule.

An Information was lodged by Stipendiary Stewards TW Taumanu and JM Muirhead alleging that Junior Horseman O Gillies improved outwards with Nullabor Song forcing Glow (Driver J Dickie)  to race wider on the track with 1300 metres to run and as a result this was a breach of the Pushout Rule.

Mr Gillies did admit to the breach of the rule and he was present.

Although Mr Gillies is a Junior Horseman he was not assisted at this Hearing because of the fact that at the Protest Hearing relating to Nullabor Song he was present with his Co Trainer Mr DM Balle and that he consented to the evidence in the Protest Hearing being used for this Hearing. Mr Taumanu confirmed that he had spoken to Mr Balle about this and Mr Balle was happy for Mr Gillies to appear on his own at this Hearing.  The explanation was accepted by this Committee.

On the basis that Mr Gillies admitted the charge then this Committee finds the charge to be proven.

In regard to penalty Mr Taumanu recommended a fine of $200.00 and this was accepted by the Mr Gillies.

The Committee accordingly took into account the submissions as well as the guilty plea and the evidence taken in the Protest Hearing and as a result imposes a fine of $200.00 on Mr Gillies.
