Charge

Following the running of Race 8, the PGG WRIGHTSON NZ YEARLING SALES SERIES No 22 CHAMPIONSHIP (LISTED) MOBILE PACE an information was filed by Stipendiary Steward, Mr S Wallis, alleging Senior Horseman, Mr R Holmes breached Rule 869 (3) (b) in that... R Holmes (Artistic Lover) drove carelessly when failing to concede his position after being shifted wider by Murphy Brown (D Dunn) near the 650 metres resulting in Murphy Brown coming into contact with the tiring Luminesce.

Following Stewards inquiries into this incident the Information was adjourned sine die and held at the Ashburton TC meeting at Ashburton on the 8th February 2014.

Mr Holmes was present at the hearing and admitted the breach.

Rule 869 (3) (b) provides:

No horseman in any race shall drive
  carelessly

Mr Wallis demonstrated on the video the relevant positions of the horses as they raced down the back straight. ARTISTIC LOVER (R Holmes) was trailing MILLIE SAMPSON in the four back one-out position. IDEAL POWER (R May) was trailing ARTISTIC LOVER and MURPHY BROWN (D Dunn) was on the pole line five deep. Approaching the 650 m mark Mr Dunn shifted MURPHY BROWN outwards forcing ARTISTIC LOVER wider. He continued the outward movement with Mr Holmes attempting to hold his ground. LUMINESCE, which was tiring came back and MURPHY BROWN struck the sulky of LUMINESCE causing it to break and lose it chances. Mr Wallis said Mr Holmes did not have the advantage over Mr Dunn and should have conceded his position. As a result MURPHY BROWN broke and IDEAL POWER was inconvenienced at that point.

Mr Holmes stated that he believed he was level pegging with Mr Dunn when he came through. He did not realise that Mr Dunn was outside the tiring horse as much. He was defending his position and when he did concede it was too late and MURPHY BROWN had galloped.

Decision

Mr Holmes admitted the charge and it is found proved.

Penalty Submissions

Mr Wallis said the race was a Listed race with a stake of $170,000. Several runners had been inconvenienced and lost their chances. Mr Holmes had no previous charges under the Rule this season. He said the interference was in the mid-range and was seeking a fine of between $700 to $800, or a suspension of four Canterbury days. Mr Holmes had admitted the breach and had been fully co-operative with the Stewards.

Mr Holmes stated he had a number of horses he wished to drive over the next few meetings and preferred a fine as opposed to a suspension. He had admitted the charge and had co-operated with the Stewards throughout their inquiries.

Penalty Decision

The committee gave credit for Mr Holmes’ early admission of the breach, his excellent record under the Rule and that he co-operated fully with the Stewards. However, we also note that the race was a Listed race with a stake of $170,000 and several runners lost their chances.

We believe a fine at the lower end of the range is appropriate.

Mr Holmes is fined $700.
