DECISION and REASON
--An information instigating a protest lodged by Stipendiary Steward Mr J Muirhead on behalf of IWI TROUBLE driven by Ms N Chilcott and placed 5th by the Judge against ENDEAVOR driven by Mr S Butcher and placed 4th by the Judge on the grounds that ENDEAVOR broke free of interference and was not in its proper gait when its nose reached the finishing line and was lapped on by IWI TROUBLE.
--Mr S Butcher representing the connections of ENDEAVOR endorsed the information "I do not contest protest against 4th". Mr Muirhead demonstrated the incident by use of the video film. ENDEAVOR broke free of interference some 40m from the finishing line and was not in its correct gait at the finishing line and was clearly lapped on by IWI TROUBLE. Mr Butcher had indicated to Mr Muirhead that he did not wish to be present at the hearing. This was a clear cut matter and in accordance with Rule 870 (5), I relegated ENDEAVOR to behind IWI TROUBLE, the final placings then being :

--5th ENDEAVOR
