Information No. 7480, filed by Chief Stipendiary Steward, Mr R Sanders, alleged that Licensed Jockey, Mr S Pateman, had committed a breach of Rule 520 (4) (c) in that “he failed to make the handicapped weight on ARRIVIDERCI and was 1 kilogram over”. ARRIVIDERCI was an acceptor for Race 1, Racecourse Hotel & Motor Lodge Sydenham Hurdles.

Information No. 7480, filed by Chief Stipendiary Steward, Mr R Sanders, alleged that Licensed Jockey, Mr S Pateman, had committed a breach of Rule 520 (4) (c) in that “he failed to make the handicapped weight on ARRIVIDERCI and was 1 kilogram over”. ARRIVIDERCI was an acceptor for Race 1, Racecourse Hotel & Motor Lodge Sydenham Hurdles.

Mr Pateman had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 520 provides as follows:-
(4) Every rider commits a breach of these Rules who:-
 (c) wilfully or without reasonable cause permits himself to be engaged to ride a horse when he knows or ought to know that he will not be able to ride the horse at the weight which it is handicapped to carry or such other weight at which he agrees to ride the horse.

Mr Sanders informed the Committee that Mr Pateman had ridden in Race 1 and was on his way back to Melbourne. Mr Pateman had flown in to Christchurch in the early hours of this morning from Melbourne and, he told the Stewards, he had trouble losing weight. He had informed the Stewards of the problem about 35 minutes prior to Race 1. Mr Pateman had been allowed to ride ARRIVIDERCI in the Race at 1 kilogram overweight. THE connections of the horse had selected Mr Pateman to ride their horse as they believed that he was the most suitable rider for the horse and they did not wish to replace him.

Mr Pateman informed the connections that he had not been fined for overweight in his entire career in Australia. Mr Sanders acknowledged that Mr Pateman’s record was a good one. Mr Sanders recommended a fine of not less than $200.

In determining penalty, the Committee took into account Mr Pateman’s admission of the breach and his good record. However, the Committee noted, the Race was a feature jumping event at the Carnival on a premier raceday. Mr Pateman ought to have made a greater effort to make the carded weight of 64.5 kgs and his failure to do so impacted on the connections of the horse, and also on punters.

Mr Pateman was fined the sum of $300.
