Stipendiary Steward Mr N Goodwin lodged an information alleging Ms K Myers permitted her mount ‘OUR UMAGA’ to shift inwards near the 800 metres when not sufficiently clear of O’CEIRINS ANGEL (K Hercock) who was checked.

Ms Kelly Myers, was represented by Mr Kevin Myers, and did not admit the breach.

Stipendiary Steward Mr N Goodwin read the rule.

Mr Rae gave his interpretation of the head and side-on films of Ms Myers on OUR UMAGA crossing over into O’CEIRINS ANGEL (K Hercock) who had settled into her rightful line of which she was entitled.

Mr Myers questioned Mr Rae on a previous incident in the race resulting in a jockey being charged having an effect on Ms Myers incident. Mr Rae replied in the negative when questioned by Mr Goodwin.

Ms K Hercock initially indicated that interference from OUR UMAGA on the outside and CELTIC ROSE from the inside coming back caused the interference. After viewing the films, she confirmed only OUR UMAGA from the outside when only a ½ / ¾ length clear was involved and Ms V Johnston was well clear.

Ms K Hercock also stated to Mr Myers and Ms Myers the previous interference eluded to have had no effect on the interference by Ms Myers.

Mr Myers stated with this race perhaps there is benefit of the doubt.

Mr Goodwin agrees that the complexion of the race did change but the evidence presented shows the previous incident did not have any effect on Ms Myers at the moment of contact and resulting interference to Ms Hercock.

The committee have clear evidence from both the head and side-on films and the compelling evidence of Ms K Hercock that OUR UMAGA (Ms Myers) was the sole contributor of the interference to O’CEIRINS ANGEL near the 800m and accordingly find the charge proven.
----
Mr Goodwin asked for a term of suspension. Ms Myers has a good record.

Penalty:
--Assessing all matters before it, including Ms Myers good record, and the degree of interference, the committee impose a term of suspension from the conclusion of racing on the 22nd February until the conclusion of racing on the 28th February 2008 (4 days).
