Following the running of Race 12, Forbury Life Members Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainer, Mr R B Ward, alleging a breach of Rule 869 (2) (d) in that he “failed to correctly affix the boring pole [on CHAMPAGNE SUPERNOVA] so as not to come adrift”.

Following the running of Race 12, Forbury Life Members Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainer, Mr R B Ward, alleging a breach of Rule 869 (2) (d) in that he “failed to correctly affix the boring pole [on CHAMPAGNE SUPERNOVA] so as not to come adrift”.
--Mr Ward had signed the Statement by the Defendant on the information form indicating that he admitted the breach and that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(d) All gear is correctly applied and/or affixed so as not to malfunction or come adrift.
Mrs Williams showed a video replay of the final stages of the Race. It showed the boring pole on the near side of CHAMPAGNE SUPERNOVA come adrift in the home straight and eventually fall to the track, after hanging down for some distance.
--Mr Ward was fined the sum of $100.
