Following Race 10 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr Oatham, alleged that Mr Parish allowed his mount HEAT HAZE to shift out near the 350 metres. He further alleged that he was not clear of CAPACIA (M Coleman) causing that horse to be checked.

Following Race 10 an Information was filed pursuant to rule 638 (1) (d). The Informant, Mr Oatham, alleged that Mr Parish allowed his mount HEAT HAZE to shift out near the 350 metres. He further alleged that he was not clear of CAPACIA (M Coleman) causing that horse to be checked.
--Mr Parish pleaded guilty to the charge.
--Mr McLaughlin, Stipendiary Steward, demonstrated the video films which showed Mr Parish moving out 2 horse widths and into the line of CAPACIA (M Coleman) when only 1 length clear. This caused Mr Coleman to check and lose ground before running on strongly to finish.
--Mr Parish, in pleading guilty, said he pulled out to go for a run and his horse moved out quicker than he thought. He said he did not realize Mr Coleman was there.
--PENALTY SUBMISSIONS
--Mr Oatham said Mr Parish had incurred 2 charges in the last 12 months. He said on this occasion CAPACIA had been adversely affected in a $35,000 race. He submitted a 4 – 6 day suspension would be appropriate.
--Mr Parish said he had commitments up to and including 16 December 2009.
--PENALTY
--The Committee carefully considered all evidence and submissions. The only mitigating factor in this case was Mr Parish’s guilty plea. This has to be balanced against the interference caused by Mr Parish in a $35,000 race to a favoured runner who was quite badly affected.
--Accordingly, taking all the above factors into account, we suspend Mr Parish from riding in races from after the conclusion of racing on 16 December 09 until after racing on 27 December 2009 (5 days).
