Following the running of Race 8, Keith Ussher Architecture Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr C P Harrison, alleging a breach of Rule 869 (2) (a) in that Mr Harrison "used his whip excessively in the run home". Mr Harrison was the driver of COURAGEOUS BABE in the Race.

Mr Harrison had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 (2) (a) provides as follows:

--

(2) No horseman shall during any race:-

(a) use his whip in an unnecessary, excessive or improper manner.

Mrs Williams showed a video replay of the final stages of the Race. She pointed out COURAGEOUS BABE, driven by Mr Harrison. In the run down the final straight, Mr Harrison hit the horse approximately 22 times, Mrs Williams alleged. Mrs Williams said that Mr Harrison’s explanation was that he was annoyed with the horse. The horse finished in 7th placing and did not respond to the use of the whip, Mrs Williams said. Mr Harrison had not previously breached the Rule. Mrs Williams recommended a fine of $200.

The Committee took into account Mr Harrison’s admission of the breach and his previous good record. However, the Committee was concerned at Mr Harrison’s excessive use of the whip on an obviously beaten runner and his explanation to the Stipendiary Stewards did him no credit.

Mr Harrison was fined the sum of $200.
