Mr P Ferris ("Eyemeup") allowed his mount to shift ground inwards shortly after the start near the 1500m when not clear, causing crowding to "Zeta Black" (G McKeon) and "Platinum Elle" (B Herd), checking "Terroir" (M Walker) and inconveniencing "Wazawatsyn" and "Snipza Gold". As a result of an incident in Race 7, shortly after the start, Mr P Ferris was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

Mr Ferris pleaded guilty to the charge, which is therefore deemed to be proved.

The evidence was presented by Mr C George, Chief Stipendiary Stewart. Video coverage of head on and side on views was shown.

Mr Ferris had drawn second from the outside. Shortly after the barrier rise, he moved across quite quickly, and caused crowding to "Zeta Black" (G McKeon) and "Platinum Elle" (B Herd) and with the further consequences of a check to "Terroir" (M Walker) as well as inconveniencing "Wazawatsyn" and "Snipza Gold".

Mr Ferris’s movement was sharp, and dictated the line of horses, "Zeta Black" in particular.

By way of explanation, Mr Ferris candidly admitted his error of judgment but asked the committee to note that Mr McKeon on "Zeta Black" had urged his mount up, which made the incident look a lot worse than it was.

PENALTY SUBMISSIONS

Mr George told the hearing that Mr Ferris had only been riding in New Zealand for three months, and in that time has incurred one suspension of three days for careless riding. That suspension was imposed as recently as 3 November 2007. Mr George took the view that the carelessness was at the higher end of the scale, and said that Mr Ferris should have maintained a straight line until such time as it was safe to move across.

He also observed that the race was a Listed Stakes for a stake of $80,000. He believed that an appropriate penalty would be a suspension in the range of 4 to 7 days. He also submitted that because of the status of the race that a fine should be imposed in the range of $500 to $1,000.

In reply, Mr Ferris submitted that he thought that the carelessness was not at the higher end of the scale and was contributed to Mr Mc Keon "kicking up" behind him. However, he then went on to say that Mr McKeon was entitled to do that. He further said that he did not appreciate the "backwash" that went on behind him, particular because he could not see that far back. He said that he made an error of judgement. He told us that he had a good record and has somewhere between 600 and 700 rides per season. He said that he had been wasting in order to secure this ride at 52 kilogrammes. Mr Ferris added that he was trying hard to establish himself in New Zealand. Because he had just come off suspension, his finances were tight and that if he was suspended, he felt that the additional penalty of a fine should not be imposed.

PENALTY DECISION

Every jockey should know that extra care has to be taken at the start of a race when drawn wide. Care must be taken when moving across to avoid compromising other horse and rider safety.

Therefore, having regard to the relatively sharp inwards movement, we are bound to share Mr George’s view that the carelessness was at the higher end of the scale. That being the case, a suspension is the appropriate penalty.

In setting the penalty, we must also have regard to the status of the race, and the stake payable, as well as the jockey’s record.

--

For those reasons, the starting point for a suspension, in our opinion, is 5 days. However, credit is given for Mr Ferris’s early guilty plea and his reasonably good record, and therefore we are able to reduce the period to 4 days. Thus, the suspension will come into effect as from the conclusion of racing on Sunday 18 November 2007 until the conclusion of racing on 24 November 2007. That encompasses meetings at Hawera, Matamata, Winton and Counties or Hawkes Bay.

We now turn to address Mr George’s submission that a fine should also be imposed. In the most recent edition of New Zealand Thoroughbred Racing Monthly, Mr George drew riders’ attention to what the attitude of Stipendiary Stewards was to be for the forthcoming season. He said "Already with more prize money on offer during the spring, and with better racing surfaces, the Stipendiary Stewards have seen a rise in careless riding charges. Riders are warned that Stipendiary Stewards will be recommending higher penalties in such cases, and in some instances an additional monetary element. It is important that we have safe racing and that all horses are given every chance of winning a race rather than having their chances interfered with."

We support what Mr George has to say and therefore, it is inescapable that a fine must also be imposed.

We set that fine at $250. In setting that fine, we have taken into account Mr Ferris’s submission that having just come off suspension, that his finances are not that good at present.
