Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Stipendiary Steward Mr A Coles, the Mr J Benner, the rider of PALMAC committed a breach of that rule when he shifted in when not the required distance clear

DECISION AND REASON

--

Following Race 2 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the Informant, Stipendiary Steward Mr A Coles, the Mr J Benner, the rider of PALMAC committed a breach of that rule when he shifted in when not the required distance clear of LADY WOODEMM (G Grylls) dictating that horse inwards causing a check to WESTON BEAU (C Ormsby).

Mr Benner admitted the charge.

Mr Treweek demonstrated the video, which showed the inward movement of PALMAC as the field left the back straight. Mr Grylls had to take evasive action, which caused subsequent interference to WESTON BEAU.

Mr Coles said that although this was Mr Benner's first charge he felt that the offence, which was, in his opinion, a misjudgement still merited a suspension.

Mr Coleman, on Mr Benner's behalf, agreed that it was a misjudgement and asked that Mr Benner's good record be taken into account.

PENALTY:

--

After taking all submissions into account the Committee accept that the offence, although not major was still of suspendable nature. Accordingly after taking into account Mr Benner's record and his guilty plea he is suspended from the completion of racing on 18 May 2005 until the conclusion of racing on 25 May 2005.
