DECISION & REASON
--Following the running of race number 4 an information was lodged by Stipendiary Stewards under Rule 869 (2) (a) alleging that Mr McCormick the driver of Jackpot Gold used the whip excessively in the run home.
----At the outset of the hearing Mr McCormick confirmed that he understood the charge and his written admittance of the breach.
----The breach is found proven.
----Ms Williams demonstrated the incident with the use of the video evidence and asked the Committee to note that Mr McCormick in a continuous manner hit the horse either with a back hand or forward hand in excess of 26 times in the run home. Mr McCormick after viewing the video acknowledged that Ms Williams' estimate of the number of continuous hits was correct.
----Ms Williams, in respect of penalty, admitted that in view of the early admittance of the breach by Mr McCormick and that there were no similar breaches over the last twelve months, that a monetary fine was appropriate. Mr McCormick agreed with the submissions of Ms Williams.

The Committee, after taking into account the submissions on penalty, imposes a fine of $200.00.
