DECISION REASON & PENALTY
--Apprentice Mr Lee Callaway admitted a breach of Rule 871 (1) (d) in that he permitted his mount BLACK WATCH to shift outwards near the 100 metres in the straight when not sufficiently clear of REGAL COURT, ridden by Mr M Walker, taking that horse's rightful line of running. Trainer Mr Mark Donoghue, who is co-trainer of BLACK WATCH was present to represent Mr Callaway.
--Stipendiary Steward Mr Oatham demonstrated the incident on the video that the outward movement by BLACK WATCH checked REGAL COURT and that no corrective measures were taken by Mr Callaway.
--Stipendiary Steward Mr Coles made submissions on penalty in that Mr Callaway had a good record recently and that a suspension of 3 days would be appropriate.
--Mr Callaway made a submission that it was only the horse's second start and that he did not realise that REGAL COURT was behind him.
--The panel took these submissions into consideration including admission of the breach and that there was a good riding record recently. The panel suspended Mr L Callaway from riding from the conclusion of racing on Saturday 25th August 2007 until the conclusion of racing on Saturday 1st September 2007. This is effectively a 3 day suspension.
