Decision:

Prior to Race 6, The Oaks Stud Manawatu Classic, Mr R Sanders made a request for a ruling.

Mr R Neal presented the case for Mr Sanders and under Rule 520 (5) requested a ruling in that jockey J. Riddell be paid a riding fee for the horse CAN’T KEEPER DOWN an acceptor in Race 6. 



Prior to Race 6, The Oaks Stud Manawatu Classic, Mr R Sanders made a request for a ruling.

Mr R Neal presented the case for Mr Sanders and under Rule 520 (5) requested a ruling in that jockey J. Riddell be paid a riding fee for the horse CAN’T KEEPER DOWN an acceptor in Race 6.  Such fee to be the equivalent payable to that received by the rider of the horse.

Rule 520 (5) reads:
“Every Owner or Trainer, and every agent of an Owner or Trainer, who, having engaged a Rider to ride in a race, willfully breaks such engagement commits a breach of these Rules. In the case of a Jockey or an Apprentice Jockey the Judicial Committee may, in addition to imposing any other penalty for that breach, direct that such Jockey or Apprentice Jockey be paid by the Owner the fee for a winning or losing ride determined in accordance with the provisions of Rule 523 and with the placing of the horse in the race concerned…”

Ms Latta, the trainer of the horse involved, explained the circumstances of the rider change to the committee.   In the week preceding today’s race meeting CAN’T KEEPER DOWN was the subject of an offer to be sold.  Ms Latta entered her for the race with the intention that if she was sold she would be withdrawn.  She asked Mr Riddell if he would ride the horse and he replied that he would “be battling to do the weight”.  Ms Latta was not too concerned with this comment because she expected the sale to go ahead in which case the horse would be withdrawn from the race.

This morning at 7.25am Ms Latta received a call from Australia and as a result of that conversation the sale of CAN’T KEEPER DOWN was put on hold.
 Ms Latta, under the assumption that Mr Riddell could not make the weight, suddenly found herself under pressure to find a rider.
Mr Leith Innes was subsequently engaged and the rider change widely circulated over the radio and via Trackside.
 Mr Riddell had, in fact, managed to make the weight and heard about the rider change on his way to the races.
As the rider change had already been extensively publicized it was decided by all concerned to leave Mr Innes on the horse.

These circumstances led to the Request for a Ruling that Mr Riddell should be compensated in some way for missing the ride.

It is obvious to all involved that this unfortunate situation would not have arisen if communication had been better between Ms Latta and Mr Riddell.  One phone call from either of them would have prevented events from unfolding as they have.

Ms Latta confirmed that she was acting on behalf of the Owners of CAN’T KEEPER DOWN and that they were aware of the request for a ruling.
It should be emphasized that Mr Riddell could make the weight and that he was replaced only due to a misunderstanding.

The committee directed that under these circumstances Mr Riddell was to be paid a riding fee and any other fee due to the placing of the horse in The Oaks Stud Manawatu Classic Group Three as stated in Rule 520 (5).
