Defendant Mr H Tinsley – Jockey for FIGURE AGAIN (R 5) and CELL MATE (R 6)
Jockey H Tinsley was charged under Rule 330 (3) (c) in that he was unable to make the carded weight for FIGURE AGAIN in Race 5 and CELL MATE in Race 6. The Rule was read and Mr Tinsley confirmed his admittance of the breach and his understanding of the Rule.
--Stipendiary Steward Mr Neal informed the Committee that Mr Tinsley came to the stewards and informed them that he was unable to make the weight for both his mounts. He had been ill on New Year’s Day and unable to attend and ride at Hastings. His weight had been an issue on New Year’s Day. Today he was one kilo over on the two rides and told the stewards he was unable to ride at 56 kilos.
--Mr Tinsley confirmed Mr Neal’s comments. He did feel unwell on New Year’s Day and elected not to ride. It was a particularly busy period for racing and his acceptance of rides had been complicated by different dates in the racing calendar and on the NZTR website. He now realized that he was unable to accept rides at 56 kilos and instructed his agent accordingly. During the time he was unwell he supplemented his diet with Powerade.
--Mr Neal told the Committee that Mr Tinsley had breached this Rule on two occasions in the last twelve months – the last being at Waipukurau on 06 December 2009 where he was fined $150.00. Mr Tinsley, he informed the Committee, was a senior and very professional rider sought after by owners and trainers. He had been forthcoming and up front with the stewards over the matter and believed this charge would be best handled by way of a fine in the vicinity of $300.00.
--DECISION AND REASON
--Mr Tinsley, in coming to our decision to impose a fine for this breach we have taken into account your admittance of the charge, your co-operation with the stewards, and the steps you have taken to hopefully ensure that this does not happen again. As a senior rider you are aware of the responsibilities you have to ensure the rides that you accept come within your weight range. The betting public invests on rides you undertake believing you can make the carded weight.
We accept it is a busy time for riders but it is your responsibility to ensure the rules are adhered to. This Committee fines you the sum of $300.00.
