Hearing Type (Code):

Decision:

The information charged jockey S Collins with a breach of Rule 871 (1) (d) ? careless riding, in that he angled his mount Quizmaster out when not the required distance clear of Mon Reve (R Jones)

Decision:

--

The information charged jockey S Collins with a breach of Rule 871 (1) (d) ? careless riding, in that he angled his mount Quizmaster out when not the required distance clear of Mon Reve (R Jones), and caused that horse to check.

--

The Informant's case was illustrated on video by Assistant Stipendiary Steward M Davidson, who indicated the movement off the rail by the Defendant's mount at the 300m mark, and the subsequent checking of Mon Reve, a favored runner, and also Don De?Oreo (S Saad).

--

The Defendant did not dispute Mr Davidson's reading of the race.

--

When asked to address penalty, the Informant confirmed the Defendant's "very good riding record" and felt that he had made an error of judgment when committing the breach. He opined that the careless riding in this instance was not major and a suspension of 3 days would be appropriate.

--

The Defendant requested that the Committee take his riding record in account when assessing penalty.

--

The Committee, taking into account the Defendant's riding record, his admission, and the nature of the breach, imposed a penalty of suspension for three (3) days; such penalty to commence at the conclusion of racing on the 11 October 2006 and to conclude at the conclusion of racing on the 15 October 2006. This penalty took into account the districts where the Defendant accepts riding engagements.
