--It was alleged that Mr Stam allowed his mount to shift inward when not the required distance, dictating the line of running of STOLE MY TIME (K Myers).
--Mr Stam denied the breach.
--EVIDENCE
--When presenting his evidence Mr Goodwin called Miss Myers to give her account of what occurred to her mount shortly after the start of the race. Miss Myers stated that she had begun well and was moving forward when pressure came from her outside. This pressure, which she identified as coming from KING KEI, forced her to change her intended line of running by having to move inward, this consequentially resulting in the runners on her inside being tightened and checked.
--Mr Goodwin then showed the films of the incident, in these he demonstrated where he believed Mr Stam rode forward on KING KEI and dictated the line of STOLE MY TIME. He contended that KING KEI was no more than three quarters of a length in front of STOLE MY TIME when Mr Stam attempted to cross that runner, and as such his riding at this this point in the race fell short of the required standard.
--Mr Stam in defending the charge admitted that he has moved in and forced Miss Myers off her line however he contended that the inward movement was due to KING KEI overreacting to being straightened.
--DECISION AND REASON
----The committee, after carefully considering all that has been presented to us find that, shortly after the start of the race was made, Mr Stam has ridden forward and has continued on an inward movement to a point where firstly STOLE MY TIME and secondly other runners have been forced to check. We further find that STOLE MY TIME was entitled to its line of running and that the actions of Mr Stam of moving inwards when not the required distance clear falls into the category of careless riding.
--We do not accept that the incident was contributed to by any over-reaction of KING KEI.
--Therefore we find the charge proven.
--PENALTY
--Having carefully considered all submissions we find that the appropriate penalty, in this case must be a term of suspension, as the interference suffered by the effected runners was significant.
--In determining the quantum to be imposed we believe that the starting point for a suspension should be 3 days, to which we then consider and apply the aggravating and mitigating factors.
--The aggravating factors are that this breach, in our view, falls toward the higher end of the scale as there has been potential for more serious repercussions of Mr Stam's riding.
----The mitigating factors are that Mr Stams record is considered a good one and also that notwithstanding his denial of the charge he has been very Co-operative at this hearing.
--Therefore after considering all these factors we find that Mr Stam be suspended for 4 days with such suspension commencing at the conclusion of racing on Thursday 10th November and expiring at the conclusion of racing on Saturday 26th November.
